Question :

Is it illegal to carry a knife whose blade flips out at...?

In the state of South Carolina, is it illegal to carry a knife whose blade flips out at the press of a button? The blade is right at 4 inches long and I heard it is illegal to own a switchblade. In my mind, a switchblade is the type of spring loaded knife where the blade shoots straight up from inside a closed handle.

My blade swings out, like a regular pocket knife, just using a spring instead a flick of the thumb. It has a safety on it that keeps it from opening in your pocket and such, and it also locks into place when open. It doesn t have a serrated edge, although the back side of the blade has decorative cuts that look almost like a serrated pattern.

I walk late at night and I never carried any kind of weapon until I was followed home twice in one week. Luckily while they were circling around the neighborhood for another pass I made it inside without anyone seeing which house I went in to. I believe they were just concerned neighbors from the subdivision next to mine where I was walking, but it s best to not take any chances. I ve also had several dogs approach me, and while I ve never had a problem with dogs being angry towards me, I don t want a stray to B-line straight for me and bite my neck off while I have to just watch until I bleed out. :(

After this I started walking with a Heavy Duty Maglite. I walk 6 miles (or close to it; I measure my distance by time since I don t have a pedometer or any other means to calculate my exact walking distance). I usually start walking between Midnight and 3 am and end by 6 am at the latest.

Of course, I occasionally have people yell and throw things at/near me, and I ve also run into a couple of groups walking from one project to another, containing anywhere from 4 to 12 people, and they re not always nice. I felt pretty safe with my MagLite but I have since also started carrying a Gas Station $1 key-chain knife that s tiny (1.5" long, maybe).

I was already worried about carrying the small knife because I didn t know the exact laws but after reading up it seems to be ok as long as I don t use it in the commission of a crime. I get stopped usually around twice a week, sometimes the officer just asking me what I m doing but other times getting a Terry pat or being fully searched (with permission). I get messed with more often than normal because there are so many policemen for our small town, they don t recognize me. Add to that I live in a very nice neighborhood, which is surrounded by the ghetto and everyone assumes I m walking over to get drugs or whatever else.

I would like to start carrying my new knife with me because I will feel much safer, but being that I get stopped so often I don t want to go to jail for it. I feel like I have the right to carry some sort of protection... especially when I could walk around with a shotgun or rifle and be within the law, from what I have come to understand.

Does anyone know if this style of knife is legal to carry on your person, probably concealed in a pocket?
Answer :
South Carolina does not define switchblades as illegal. However it does consider any knife with a blade over 2 inches in length as a Deadly Weapon. It is illegal to carry one concealed. You also need to be aware that once you pull your knife you are subject to mandatory prison sentences if found in the wrong. South Carolina is a favorite for knife law questions and it is because they have their Deadly Weapon statute combined with the firearm offenses.

"Any person carrying a deadly weapon usually used for the infliction of personal injury concealed about his person is guilty of a misdemeanor, must forfeit to the county, or, if convicted in a municipal court, to the municipality the concealed weapon, and must be fined not less than two hundred dollars nor more than five hundred dollars or imprisoned not less than thirty days nor more than ninety days. Nothing herein contained may be construed to apply to (1) persons carrying concealed weapons upon their own premises or pursuant to and in compliance with Article 4 of Chapter 31 of Title 23, or (2) peace officers in the actual discharge of their duties. The provisions of this section do not apply to rifles, shotguns, dirks, slingshots, metal knuckles, or razors unless they are used with the intent to commit a crime or in furtherance of a crime."
